What is the AVG?
The AVG is a new European law for the protection of personal data. The English title of this law is the General Data Protection Regulation (GDPR). Any organization that stores and uses personal data of European citizens must abide by it. The AVG entered into force on May 25, 2016 and will apply from May 25, 2018. This means that from that date the same privacy legislation applies throughout the European Union (EU). The Personal Data Protection Act (Wbp) no longer applies. In the past two years, organizations and regulators have been able to comply with the new regulations.
What does the AVG entail?
The AVG obliges organizations to protect privacy-sensitive data according to the requirements in the regulation. Key points of the AVG are:
- your organization must protect personal data as secure as possible
- if a data subject so requests, you must delete his or her personal data
- people must always have access to their data and be able to change it
- you must be able to prove the usage of the data and how you store it.
- your organization may need to appoint a data protection officer
You must report serious data leaks within 72 hours to the Dutch Data Protection Authority and sometimes to those involved - if the AVG is violated, a fine can be imposed with a maximum of 4% of the annual turnover or 20 million euros.
What data is this?
The AVG applies to the personal data of your customers, relations, partners, suppliers, employees and other citizens. There are direct and indirect personal data. Direct personal data includes, among other things, date of birth, first and last name, gender, address, passport photo, telephone number, e-mail address, citizen service number (BSN), bank account number and patient file. Indirect personal data includes data that is not directly about the person, such as WOZ value, license plate number, the profit of a sole trader and the IP address of a computer. In addition, the AVG applies to metadata, such as a customer number or the date on which you have stored personal data.
